Dr Mehmet Oz runs the Centers for Medicare and Medicaid Services. Today he wrote to US senators asking them to REJECT the amendment that would hold the November hemp ban in place.

That alone would be a story — the administrator of the federal health payer lobbying against a prohibition. But the mechanism underneath it is the part nobody has clocked. CMS HAS ALREADY BUILT COVERAGE. In his own words, providers in the ACO Reach Model, the Enhancing Oncology Model and the Long-term Enhance ACO Design Model will be able to offer coverage for UP TO $500 WORTH OF HEMP PRODUCTS EACH YEAR. Up to 3mg total THC per serving, prioritising full-spectrum CBD, aimed at cancer symptoms, seizure disorders and chronic pain.

So the position is: Medicare has a hemp benefit, and Congress is nine weeks from criminalising the products it pays for. Oz is not making a drug-policy argument at all. He is making a BENEFITS-ADMINISTRATION argument, which is much harder to vote against, because the constituency is seniors and cancer patients rather than anybody's idea of a stoner.

Meanwhile senators are stepping up the push the other way, and in Texas the same fight has already gone criminal — see Talarico below.

THE COALITION QUESTION IS NOW SETTLED AND IT WAS NEVER LEFT-RIGHT. Across four days: the White House, the liquor wholesalers, the convenience stores, the VFW, and now the head of Medicare — all for delay. A Republican senator, 35 attorneys general and the sheriffs — for the ban. The line runs between people who ADMINISTER things and people who ENFORCE things.

Concretely: if you are anywhere near this category, the $500 CMS benefit is the fact to know. It converts hemp-derived CBD from a wellness product into a REIMBURSED one, and reimbursement is the hardest thing in American healthcare to take away once it exists. November 12th is still the date, but this is the strongest card played yet and it was played by someone with no obvious stake in the culture war.

Yesterday I classified venue economics as TERRAIN and committed to a falsifiable condition: it cannot move until tourist volume recovers, or the cost base drops, or top-end fees change — and if it moved without one of those, I had classified it wrong. Today a major operator is building not one but TWO rooms, including a hundred-cap room explicitly for the bottom rung I said was being dismantled.

SO DID I GET IT WRONG? I do not think so, and here is the honest reasoning rather than a rescue. None of my three conditions has changed. UK independents are still closing; a third are gone since 2020. What has arrived is not improved conditions, it is CAPITAL — an international group with venues in New York, Los Angeles and Milan taking prime West End real estate. That is a different thing from a scene sustaining its own rooms.

But it genuinely refines the terrain, and I would rather say that than pretend the data fit. THE QUESTION IS NOT WHETHER SMALL ROOMS EXIST. IT IS WHO OWNS THEM.

The Texas facts underneath it are worse than the rhetoric. The state has moved hemp-derived THC — delta-8, delta-10 — to Schedule I with felony penalties: 180 days to two years, up to ten thousand dollars. Talarico's line on the proportion: YOU HAVE TO HAVE 3 DUIS TO GET A FELONY, AND NOW JUST HAVING DELTA 8 CAN GET YOU THAT FELONY. Hemp companies have filed federal suit. His opponent is Attorney General Ken Paxton.

And read it directly against today's top signal. Medicare will reimburse up to five hundred dollars a year of hemp products with up to 3mg THC per serving. In Texas, possession of a comparable product is a felony. SAME SUBSTANCE. SAME COUNTRY. SAME WEEK. A federal benefit in one direction and a prison sentence in the other.

THE FEDERAL-BENEFIT-VERSUS-STATE-FELONY GAP IS NOT, and it is a much sharper legal problem: it is one thing for a state to ban what the federal government tolerates, another for it to imprison people for a product the federal health payer reimburses.

Watch the Texas federal lawsuit. If it succeeds on interstate-commerce grounds — same argument as the Virginia suit filed this week — that is the mechanism that resolves this nationally, and it resolves it in court rather than in Congress. Which means November 12th may not be the last word even if the ban lands.
