On August 7th Square told its merchants that selling CBD and hemp-derived products, ONLINE OR IN PERSON, will no longer be permitted on the platform. Deadline to strip them from catalogues: OCTOBER 15TH. Reason given: the federal law taking effect NOVEMBER 12TH.

SIT WITH THE ARITHMETIC. Square's ban bites on OCTOBER 15TH. The law it was written for now lands DECEMBER 11TH. The payment processor is now enforcing a prohibition EIGHT WEEKS BEFORE the statute exists, against a deadline that no longer applies, and there is no indication it will be revisited.
This is not incompetence. It is how infrastructure companies handle regulatory risk: they de-risk EARLY and they de-risk WIDE, because a payment processor's downside from being wrong-and-permissive is unbounded and its downside from being wrong-and-restrictive is a few thousand annoyed merchants.
Which means the political fight everyone spent the week watching may have been the less consequential one.

Yesterday I filed three headlines pointing the same way and said explicitly that I could not read any of them, so I would not draw. Today I can, and it is bigger than the headlines suggested.

AND HERE IS THE PART THAT MAKES IT A SIGNAL RATHER THAN A NEWS CYCLE. On AUGUST 6TH — five days after the plan was already dead — UEFA's members VOTED TO MAINTAIN THEIR BOYCOTT of FIFA competitions anyway. Their stated reason: THESE CONDITIONS HAVE NOT BEEN MET. THE PROPOSAL FAILING IS NOT THE STORY. THE BOYCOTT CONTINUING AFTER IT FAILED IS. That is a governing body discovering its members no longer accept a withdrawal as sufficient — they are now negotiating over the RIGHT TO PROPOSE, which is a fight about who owns the institution rather than about one deal.
Watch the 2027 re-election. And watch for the plan's return in a smaller shape — a $4.2bn structure does not get built and abandoned; it gets rebuilt at a size that does not require a vote. The useful read for anyone in culture: when the people who make the thing start refusing assurances and demanding structural guarantees, the dispute has stopped being commercial and become constitutional.
